End-User License Agreement — Improbability Works Games
This End-User License Agreement (“Agreement”) is a binding legal contract between you (“Player”) and Improbability Works — William Pottier, sole trader registered in France, SIREN 515 215 390, 87 avenue Léon Blum, 33110 Le Bouscat, France (“Improbability Works”, “we”, “us”) — governing your right to install and use any video game published by Improbability Works, including Velvet Door (collectively, the “Game”).
By installing, launching, or playing the Game, you confirm that you have read, understood, and agreed to this Agreement. If you do not agree, do not install the Game and request a refund through the platform from which you purchased it.
This Agreement supplements — and does not replace — the terms of service of the platform through which you acquired the Game (Steam Subscriber Agreement, Epic Games Store EULA, etc.). In the event of a conflict, platform terms prevail with respect to the platform’s own services; this Agreement prevails with respect to the Game itself.
The conditions applicable to simple use of the improbabilityworks.studio website are set out in the Legal Notice.
Acceptance and eligibility
You must be at least 13 years old to enter into this Agreement. If you are under the applicable age of majority in your country of residence, a parent or legal guardian must accept this Agreement on your behalf.
By installing or playing the Game, you represent that you have the legal capacity to form a binding contract, or that a parent or guardian has done so on your behalf.
License grant
Subject to your compliance with this Agreement, Improbability Works grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to:
- install the Game on hardware devices you own or control, in accordance with the platform’s installation rules;
- run and play the Game for personal, non-commercial purposes.
No title or ownership in the Game or any part of it is transferred to you. All rights not expressly granted are reserved by Improbability Works.
Restrictions
You may not, and may not permit others to:
- copy, sell, sublicense, rent, lease, or otherwise transfer the Game or your license rights;
- reverse-engineer, decompile, disassemble, or attempt to derive source code from the Game, except to the extent expressly permitted by applicable law;
- modify, adapt, translate, create derivative works of, or incorporate the Game or any part of it into another product;
- remove, alter, or obscure any copyright, trademark, or other proprietary notices;
- use cheats, exploits, automation software (bots), or any unauthorized third-party software that modifies or interferes with the Game;
- use the Game to harass, threaten, or harm other players;
- circumvent, disable, or otherwise interfere with security-related or digital-rights-management features of the Game;
- use the Game for commercial purposes, including in-person tournaments with a prize pool, without our prior written consent.
Online features and multiplayer
Certain features of the Game — including cooperative multiplayer for 2 to 4 players — require an internet connection and a valid account on the relevant platform (e.g. Steam). You are solely responsible for your internet connection and any associated costs.
Improbability Works reserves the right to modify, suspend, or permanently discontinue online features at any time, with or without notice, for any reason including commercial, legal, or technical reasons. Discontinuation of online features does not entitle you to a refund of the Game, but does not affect any statutory rights you may have under consumer law.
You agree to conduct yourself respectfully in multiplayer sessions. Improbability Works may revoke your access to online features, without refund, if you engage in harassment, cheating, hate speech, or any conduct that violates this Agreement or applicable law.
Distribution platforms
The Game is or may be made available through third-party distribution platforms including Valve Corporation (Steam) and Epic Games Inc. (Epic Games Store). Each platform operates under its own terms, which you agree to when creating an account.
Improbability Works is not responsible for the availability, operations, practices, or terms of any platform. Matters relating to purchases, refunds processed by the platform, and account management are governed by the platform’s own policies.
Intellectual property
The Game — including all code, art assets, music, sound design, narrative, characters, trademarks, trade dress, and visual identity — is and remains the exclusive property of Improbability Works or its licensors, protected by copyright, trademark, and other intellectual property laws.
You retain no intellectual property rights in the Game by virtue of this Agreement. Any feedback, suggestions, or ideas you submit regarding the Game may be used by Improbability Works freely, without compensation or attribution obligation.
Fan art, non-commercial videos, and streaming of the Game are encouraged, provided they do not disparage Improbability Works, are clearly identified as fan-made, and do not falsely suggest endorsement.
Updates and changes
Improbability Works may, at its discretion, release patches, updates, or new content for the Game. Some updates may be required to continue accessing online features. Improbability Works does not guarantee the availability or continuity of any particular feature or content over time.
This Agreement may be updated from time to time. The “Last updated” date at the top of this page reflects the most recent version. Continued use of the Game after a material change constitutes acceptance of the new terms. For significant changes, we will provide reasonable notice on our website or through the platform.
Termination
This Agreement is effective until terminated. It terminates automatically, without notice, if you breach any provision. Upon termination, you must cease all use of the Game and delete all copies in your possession. Provisions that by their nature should survive termination (including ownership, disclaimer, limitation of liability, and governing law) will do so.
Platform terms may have separate rules about installed copies; those rules apply in parallel.
Legal warranties — consumer rights
Statutory warranties (EU / France). As a consumer in the European Union, you benefit from mandatory statutory warranties that this Agreement cannot limit or waive:

Legal warranty of conformity (garantie légale de conformité) under Articles L. 217-1 et seq. of the French Consumer Code, implementing EU Directive 2019/770 on contracts for the supply of digital content: if the Game does not conform to the contract at the time of delivery or, for ongoing supply, during the supply period, you may request repair, replacement, a proportionate price reduction, or, where these remedies are unavailable or fail, a full refund. The warranty period is two years from delivery for a one-time purchase.

Legal warranty against hidden defects (garantie légale contre les vices cachés) under Articles 1641 et seq. of the French Civil Code: if the Game is affected by a hidden defect making it unfit for its intended purpose, you may, within two years of discovering the defect, choose between a full refund (rescission of sale) or a partial refund (price reduction), retaining the Game.
These warranties are in addition to any voluntary commercial warranty offered by Improbability Works.
Withdrawal right. Under EU consumer law (Articles L. 221-18 et seq. of the French Consumer Code, implementing EU Directive 2011/83/EU), you normally have 14 days from the date of purchase to withdraw from a distance contract without giving reasons. However, pursuant to Article L. 221-28 12° of the French Consumer Code, you expressly waive this right of withdrawal once you begin downloading or installing the Game, having been informed of this waiver and having given your prior express consent through the platform checkout process.
Refund requests based on platform policies must be directed to the relevant platform (Steam, Epic Games Store).
Limitation of liability
Except as required by mandatory law, the Game is provided “as is” without any warranty of merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by applicable law, Improbability Works’ total cumulative liability to you arising out of or related to this Agreement — whether in contract, tort, strict liability, or otherwise — shall not exceed the price you paid for the Game (excluding any platform fees).
Improbability Works is not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages (including loss of data, loss of profits, or loss of enjoyment) arising from your use of or inability to use the Game, even if Improbability Works has been advised of the possibility of such damages.
Nothing in this Agreement limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded under French or EU mandatory consumer law.
Governing law and jurisdiction
This Agreement is governed by the laws of France, without regard to conflict-of-law principles.
Any dispute arising out of or in connection with this Agreement that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the competent courts of Bordeaux, France.
EU consumers may also rely on the mandatory consumer protection provisions of their country of residence, and may access the European Commission’s Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.

General provisions
If any provision of this Agreement is held invalid or unenforceable, the remaining provisions continue in full force and effect. Improbability Works’ failure to enforce any provision does not constitute a waiver of that provision or any other. This Agreement constitutes the entire agreement between you and Improbability Works regarding the Game, and supersedes any prior representations or understandings.
